c. Zest and Salt may at any time alter these Terms and Conditions. You should our site regularly in order to be up to date with the Terms and Conditions. If you do not agree with updated iterations of the Terms and Conditions, you should stop using our site. It is advisable you retain a copy of these Terms and Conditions for your reference.

d. Any clause that is deemed to be unenforceable (pursuant to judgement from a court having competent jurisdiction) for any reason will be altered to the extend the existing provision is unenforceable. 

e. By using the Zest & Salt website and services, you maintain that you are of legal age to agree to the Terms and Conditions, or, if you are not, that you have obtained consent from a parent or legal guardian to agree to these Terms and Conditions on your behalf (the person giving this consent will be bound by these Terms and Conditions). If you violate or refuse these Terms and Conditions, you may not access to and use the Zest & Salt website and services.

f. If you breach these Terms and Conditions and Zest & Salt chooses not to enforce this immediately after the breach, Zest & Salt retains the ability to exercise its rights and seek remedy at a time of its choosing or in another other situation where the Terms and Conditions are breached by you.

g. You may not assign, transfer, or sublicense any of your rights or obligations to another party under these Terms and Conditions.

h. We maintain the right to assign, transfer, or sublicense any of our rights or obligations under these Terms and Conditions without any restriction.

i. Zest and Salt shall not be liable for any failure or delay in the performance of our obligations under these Terms and Conditions or any unavailability thereof that is due, in whole or in part, directly or indirectly to an event, circumstance or failure which is beyond our reasonable control or is a reasonably unforeseeable event.

5. Access to and Availability of the Zest & Salt Website and Services

a. Please only use this site if you are resident on mainland Singapore. If you choose to access our site or services from outside mainland Singapore, you do so at your own risk and Zest and Salt is not in any way responsible for your outcomes.

b. We do not guarantee uninterrupted, reliable or permanent access to our site:

i. You shall be responsible for obtaining and maintaining any equipment or services needed to connect to, access or otherwise use our site and services, including, without limitation, modems, hardware, software, and/or a telephone service.

a. your access or use of, or inability thereof to access or use, our sites; 

b. any purchase, refund or other like transaction conducted through or facilitated by our sites; 

c. any claim attributable to errors, omissions, deficiencies, or other inaccuracies in the sites; 

d. any unauthorized access to, or use, disclosure or alteration of, your transmissions of data including, without limitation, your personal information or card holder data, 

e. statements or conduct of any third party on the sites; or 

f. any other matter related to the sites, including their content, regardless of any negligence of any zest & salt entity even if a zest & salt entity or its representative has been advised of the possibility of such damages.

You specifically acknowledge and agree that, to the extent permitted by applicable law, we will not be liable for any defamatory, offensive or illegal conduct of any shopper or other user of the sites.

10. Complaints and Dispute Resolution

a. Prior to commencing legal proceedings, you will make a bona fide attempt to contact us and resolve any claims or disputes with us under or in connection with these Terms and Conditions. We shall engage with you in good faith

i. Each party shall, to the extent reasonable possible, continue to perform its obligations under these Terms and Conditions even if there is a dispute. This Section does not affect either party’s right to seek urgent interlocutory and/or injunctive relief.

b. These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of Singapore and you and Zest & Salt agree to submit to the jurisdiction of the courts of the Republic of Singapore.

11. Termination

a. These Terms and Conditions are effective unless and until terminated by either you or Zest & Salt. You may terminate these Terms and Conditions at any time, so long as you cease using our services. 

b. We also may terminate these Terms and Conditions at any time without notice, and deny you access to the Zest & Salt services, if in our sole discretion you fail to comply with any term or provision of these Terms and Conditions. 

i. Upon any termination of these Terms and Conditions by either you or Zest & Salt, you must promptly destroy all content obtained from us, as well as all copies of such content, whether made under these Terms and Conditions or otherwise.

The contract will be concluded in English. The details of your contract will be retained by us. If you require any information about orders you have placed with us, you can either log-in to your Zest & Salt account or contact us via support@zestandsalt.com.

AVAILABILITY OF STOCK

Not all items are readily available for sale all the time. We make every effort to update our web site to reflect out of stock conditions. It may possible that an item you purchase at ZestandSalt.com is on back order. In that event, we may replace the product with another brand of equal or higher value product.
